De Minimus Shipments Spared from Tariffs on Chinese Imports

The Trump Administration had proposed collecting Section 301 tariffs on imports from China shipped direct to consumers and valued at less than $800. The Office of Management & Budget dropped the proposal on February 17, 2021. The President has announced a six month review of Section 301 tariffs on Chinese products before deciding on a future tariff policy toward China. The current policy places tariffs of up to 25 percent on consumer goods.

The decision to remove “de minimus” shipments from potential Section 301 tariffs offers goods from China the opportunity to enter the U.S. duty-free, provided they are shipped direct to consumer and valued under the $800 threshold to qualify.
